Evidence

The rules of evidence govern how a fact must be proven during a court proceeding. Evidential issues that often arise during criminal proceedings include hearsay, the voluntariness of admissions, and the legality of arrests and searches.

When the defence and the prosecution disagree about the admissibility of evidence, a determination must be made after a pretrial proceeding called a voir dire.
