In NSW, the Traffic Offenders Intervention Program is a Local Court program aimed at reducing the likelihood of people committing further alcohol or safety related traffic offences. This is done through a series of education sessions that are designed to increase people's understanding of their legal and social obligations as a road user, the seriousness with which the Courts treat certain offences and the punnishments applicable, the impact that traffic offences can have on the community and the steps that people can take to avoid reoffending.

When sentencing a traffic offender, the Judge or Magistrate will give credit for completion of the Traffic Offenders Intervention Program because:

  • It is punitive (in other words attendance is a punishment in itself)
  • Attending shows contrition
  • People who attend are less likely to reoffend
  • The Guideline Judgment on High Range Drink Driving (PCA) offences says completion of the program is a proper basis for a reduction in the otherwise appropriate disqualification period and fine

SHOULD I ENGAGE A LAWYER FOR MY TRAFFIC MATTER?

It is your choice whether to speak for yourself in court or have a solicitor represent you. It is important to bear in mind that although traffic offences are often trivialised in the community, they are taken very seriously by the Court. It can also be very daunting for a person who has no experience with the criminal justice system to present a plea infront of a Magistrate in a crowded courtroom. PROGRAMS AND ENROLMENTS

The program is convened through a variety of providers across Sydney and New South Wales and can be done over one day (SAVE and Road Sense), two days (PCYC) or one night a week for six weeks (PCYC). It is absolutely essential that you enrol in a program accredited under Part 8 of the Criminal Procedure Regulations, otherwise the Court may not take your attendance into account. The following programs are all accredited and their contact details are listed here:

There is also a program located at Nowra and Bateman's Bay called the "Serious Traffic Offender's Program" (STOP). This program is not accredited but given the limited options available in the area the court will generally give credit to those who undertake it.

No matter what type of traffic matter you have before the Court we recommend you undertake the Traffic Offender Program. In some cases we will recommend the six week course both because it can show greater contrition, endeavour and commitment on the part of an offender, and because there is sometimes a strategic benefit to having sentence proceedings delayed.

WHAT THE GUIDELINE JUDGMENT SAYS ABOUT TRAFFIC OFFENDER INTERVENTION PROGRAMS

The Guideline Judgement has the following to say about Traffic Offender Intervention Programs and drink driving charges:

"There is evidence that suggests that attendance at such a program lessens the likelihood of reconviction for drink driving. This may be not only because of the educative value in causing the offender to appreciate the consequences of such conduct but also because of the humiliation experienced by an offender in being required to attend such a program.”

The judgement also covers High Range PCA offences specifically:

"Notwithstanding the undoubted beneficial effect upon a driver of participation in a driver education program, that fact can have little impact, in my view upon the appropriate sentence to be imposed for an offence of high range PCA in the usual case, except in so far as the length of disqualification may be concerned or the amount of a fine. The offence in general is so serious and the criminality involved in even a typical case so high that, in my view, the participation of the offender in a program cannot be seen as an alternative to punishment for an offence of this nature. In particular there is no warrant at all for the making of an order under Section 10 simply because the offender has participated in such a program or is to do so as part of the conditions of a bond."

In our experience participation in a Traffic Offender Intervention Program reduces the fine and period of disqualification or suspension, and in some cases (notwithstanding the Guideline Judgment) it can contribute to the Court not imposing any punishment at all but instead dismissing a charge pursuant to s 10 or allowing a Licence Appeal.

WHY SHOULD I DO THE TOIP?

The benefits include:

  • Potentially leading to a lesser sentence or fine
  • Enabling you to improve their driving skills and knowledge
  • Helping you to reduce the chance of reoffending and appearing in court again.

WHAT ARE THE COSTS?

The cost are generally around $150 depending where the Traffic Offenders Program is undertaken. The largest provider of the TOIP is the Police Citizens Youth Clubs (PCYC).

AM I ELIGIBLE TO DO THE TOIP?

Most Traffic Offender Intervention Programs will allow anyone to attend, however, the course is most appropriate for people who:

  • Are a traffic offender
  • Have not been sentenced for their traffic offence
  • Have agreed to participate

Some Traffic Offender Intervention Programs (notably the Seven Hills Program) insist that a Court provides a specific referral. Most Courts will happily refer offenders to the course if they have not yet done it.

WHAT IS INVOLVED IN THE TRAFFIC OFFENDER INTERVENTION PROGRAM?

Topics covered vary from TOIP providers. At the Redfern / South Sydney Police Citizens Youth Club the following are covered:

  • Drink, Drugs And Driving
  • Dangerous Road Behaviours
  • Emergency Response
  • The Legal System
  • Crash Casualties
  • Actions And Outcomes

There is a workbook that must be completed including a “final reflection” where you will be required to comment on what you have learned at the course and your reflections on your offence generally. The comments included in this section sometimes are included in the completion report that is forwarded to the Court so please take your time and choose your words carefully.
