In this section you will find information about the circumstances in which a person suspected of involvement in criminal conduct can be forced to forfeit their assets or money to law enforcement agencies.

Please select the area you would like to know more information about or read on for general information about asset forfeiture.

General Information About Asset Forfeiture

There are 3 situations where asset forfeiture can be ordered:

  • Following conviction of a serious offence
  • Where there has been no conviction
  • Where there has been no charge, but a charge is expected to be laid within 48 hours

Assets may be forfeited to one of the following agencies:

  • NSW Director of Public Prosecutions
  • NSW Police
  • NSW Crime Commission
  • Commonwealth Director of Public Prosecutions

Various orders can be made in relation to asset forfeiture. Which order may apply to you will depend on a number of things, including whether or not you have been charged with an offence and whether that charge relates to a NSW or Commonwealth offence.

We can give you further information on how to reduce the effect of a forfeiture order to avoid hardship to dependants. We can also help you apply to exclude certain property from the forfeiture order or to appeal the decision of the court to make the forfeiture order. Please do not hesitate to contact us on 9261 4555.
