Maitland Local Court

The Local Court is the court where all criminal matters involving adults commence, and where summary criminal matters including traffic offences and apprehended violence order matters are finalised. Criminal matters where the accused is under 18 and apprehended violence order matters where the respondent is under 18 are dealt with in the Children’s Court.

Serious indictable criminal matters must be finalised in the District Court or Supreme Court.

Maitland Local Court Court opens its doors at 9:00 am, and different types of matters commence being heard at either 9 am or 9:30 am. You should always double-check your listing to ensure that you arrive on time. The court is an AVL court, meaning that it has audio-visual link capacity allowing individuals to appear via AVL as appropriate. If you are attending in person and are uncertain where you need to be, you can ask at the Court Registry which can be found by following the wrap-around veranda to your left as you face the courthouse.

You should come to court prepared to be there all day as Magistrates do not hear matters in any particular order and will typically hear short matters (requests for an adjournment) first, before proceeding on to longer matters such as sentences. You should be dressed neatly and conservatively.

Maitland Local Court is part of a circuit, which sits in different locations on specified days. Courts on the same circuit are typically presided over by the same Magistrate.

Maitland Children’s Court

While the Local Court deals with criminal matters where the accused is aged 18 or older, the Children’s Court deals with criminal matters where the accused is under 18 as well as hearing child protection and adoption matters.
