John Sutton

In NSW, drivers involved in car accidents have certain legal obligations. These obligations include requirements to exchange details, remaining at the scene of an accident and reporting an accident to police (where someone is injured, property is damaged or where a car needs to be towed from the scene).

Some of the most common offences relating to car accidents are:

  • Failing to Stop and Give Particulars;
  • Failing to notify Police of car accident;
  • Failing to Stop and Assist After Impact Causing Injury;
  • Failure to comply with Responsible Driver Form of Demand.

Failure to comply with these obligaitons often leads to a person being charged with a criminal offence. This is particularly so where the details of the drivers involved in the car accident are not exchanged as the other driver has little choice other than to report the matter to police to either claim insurance or ascertain the identity of the driver. A court date, possible criminal conviction and court imposed penalties are often far worse than the insurance claim at hand.

The consequences can be serious with drivers having to attend court and face either monetary penalties, or penalties that may include maximum sentences of imprisonment.
