An offer of settlement is an offer made by one party to the other party to discontinue the matter and agree to the terms that are set out in the offer to settle.

There are two types of offers of settlement, Made and Received. Made is the offer that you make to the other party and Received is an offer that the other side has made to you.

Made

If an offer of settlement is made to the other side, your lawyer is required to advise you of the following:

  • Your actual costs, both paid and owing up until the date of offer to settle; and
  • The estimated costs to complete your matter.

Your lawyer is required to advise you of the following as it is set out in the Family Law Rules 2004.

Received

When your lawyer receives an offer to settle from the other side, your lawyer is required to advise you of the following:

  • The offer that the other side made;
  • Your actual costs, both paid and owing up until the date of offer to settle; and
  • The estimated costs to complete your matter.

Your lawyer is required to advise you of the following as it is set out in the Family Law Rules 2004.

Counter Offers

You are allowed to say no to an offer of settlement, but to assist in the progress of your case it is recommended that you make a counter offer. A counter offer is an offer in response. The counter offer will outline what you are willing to settle for.
