"Actual bodily harm” is a more serious category than a common assault, as an actual injury or harm has to be shown. In NSW, there is case law that defines actual bodily harm as an injury that is “more than merely transient or fleeting.” Commonly, scratches and/or bruises to another person can be defined as actual bodily harm. On occasion, it can also cover serious psychological injuries.

As these matters all involve injury to another person to some extent, they are taken very seriously by the Courts, especially given the current political climate regarding alcohol-related violence.
