‘Tis the Season for Drug Possession

The Festival, Christmas and New Year period can be a busy time for criminal lawyers dealing with people who have been charged with possession and supply of Prohibited Drugs; whether that be MDMA, Cocaine, Ketamine or any of the other illicit substances.

Many of these are young offenders all of whom have futures to live, some have good jobs or are studying at a tertiary level. Some have plans to travel overseas, have hopes for a career; and none of them want a drug-related criminal conviction; which would assuredly impact their ability to fulfill their future aspirations.

Some are visitors from other countries and have only been on in Australia for a short while. All are terrified about how they have ruined their future. All want a guarantee that they will not receive a criminal conviction. All should have read this blog before heading out with drugs on them and recognised that police will be out there making arrests, and people will be convicted as criminals in 2019.

Because of the recent deaths related to drug use at festivals, there is increased pressure on the courts by the community, to be tougher on drug-related crime. Police are becoming better at detecting those carrying drugs and more resources are being channelled to festivals and events in an attempt to curb these offences, which only results in more arrests and convictions.

What is assured, is that police will be conducting major drug operations at many major events and festivals over the festive season 2018-19. This means K9 officers will be working overtime detecting all you would be partygoers, no matter where you decide to carry the drugs. Every year we have numerous clients come to us with the embarrassment of explaining the thought process behind the secretion of drugs, in all sorts of places.

In addition to the embarrassment of admitting where drugs were hidden, courts will inevitably conclude that because the method of concealment is more sophisticated, your offence is aggravated. This makes a non-conviction significantly less likely.
